A veterinarian is suing the Texas Board of Veterinary Medical Examiners (TBVME), saying that the board violated his First Amendment free speech rights by revoking his license and prohibiting him from offering remote veterinary services through telephone and the Internet.

Conor Beck, program manager for communications at the Institute of Justice (IJ), asserts that Dr. Ron Hines, DVM offered free online communications via website, email, and occasionally over the phone between 2002 and 2012. Then, in 2013, the Texas Board of Veterinary Medical Examinations revoked Hines’ license, penalized him, and required him to retake a portion of his veterinary license examination due to his illegal remote actions.

According to Michelle Griffin, General Counsel for TBVME, “Section 801.351 of the Texas Occupational Code requires an in-person inspection of animals or appropriate visits to the premises where animals are raised in order to establish a veterinary-client-patient relationship.”
